These Terms of Service (“Terms”) govern access to and use of Acmetutor’s websites, applications, courses, creator tools, billing, and related services (the “Services”). By accessing or using the Services, you agree to these Terms together with our Privacy Policy, User Policy, and Instructor Policy (if you offer courses), each as updated from time to time.
Eligibility
You must be able to form a binding contract in your jurisdiction to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization. Individuals under 13 may not create an account. Users under 18 may only use the Services with the involvement and consent of a parent or legal guardian where required by law.
Accounts and security
You are responsible for safeguarding your login credentials and for activity under your account. Notify us promptly of unauthorized access. We may suspend accounts that pose risk to the platform or other users.
The Services
Acmetutor provides an online environment to discover, purchase or enroll in, and consume educational content, including video, text, quizzes, games, and community features. Features vary by course and account type. We may modify, suspend, or discontinue parts of the Services with reasonable notice where practicable.
Fees, billing, and taxes
Paid offerings are processed by third-party payment processors (such as Stripe or Braintree). You authorize us and our processors to charge your selected payment method for purchases, subscriptions, and applicable taxes. You agree to processor terms when you pay. Pricing, currency, and refund rules are shown at checkout and may depend on the instructor’s settings and our policies.
Creator / instructor relationship
If you publish courses on Acmetutor, additional commercial terms (revenue share, payouts, content standards) may apply as presented in your dashboard or separate agreement. Instructors are independent of Acmetutor unless expressly stated otherwise; Acmetutor is a platform provider.
License to use the Services
Subject to these Terms, Acmetutor grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal or internal business learning in accordance with applicable policies. Course materials are licensed as described at enrollment—not sold outright—unless otherwise stated.
Intellectual property
The platform, branding, software, and documentation are owned by Acmetutor or its licensors. Course content is owned by instructors or their licensors. You may not copy, scrape, redistribute, or publicly perform course materials except as permitted by the instructor’s license and these Terms.
Virtual currency and gamification
Some features may involve virtual currencies or rewards. Those programs are described in our Virtual currency policy. Virtual items may not be redeemable for cash except as expressly stated.
Disclaimers
THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACMETUTOR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. EDUCATIONAL CONTENT IS FOR GENERAL INFORMATION AND LEARNING; IT IS NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE TAILORED TO YOUR SITUATION UNLESS PROVIDED BY A QUALIFIED PROFESSIONAL IN A COMPLIANT MANNER.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACMETUTOR AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR CONTENT. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO ACMETUTOR FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.
Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Acmetutor from claims arising out of your content, your violation of these Terms, or your violation of others’ rights.
Termination
You may stop using the Services at any time. We may suspend or terminate access for breach, risk, or legal reasons. Sections that by their nature should survive will survive termination.
Governing law
These Terms are governed by the laws of the State of Delaware, consistent with the User Policy, excluding conflict-of-law rules that would apply another jurisdiction’s law. Courts or arbitration may apply as required by mandatory consumer protections in your country.
Changes
We may modify these Terms by posting updates on the Site. Material changes may be communicated by email or notice when you next log in. Continued use after the effective date may constitute acceptance where permitted by law.
